1. Acceptance of Terms

Welcome to EnateHomeschool.com (the “Site”). By accessing or using the Site and its services, you agree to be bound by these Terms of Use (“Terms”). These Terms form a legally binding agreement between you and Enate Homeschool (“Enate”, “we”, “us”, or “our”). If you do not agree with any part of these Terms, you must not use the Site or services.

By using the Site on behalf of an organization or as a parent/guardian for a child, you represent that you have the authority to accept these Terms on behalf of that organization or as the responsible adult. If you do not have such authority, you should not use the Site.

2. Description of Services

Enate Homeschool provides an online platform and related tools designed to assist with home education. Our services (the “Services”) include:

  • Homeschool Assistant (Text & Voice Chat): An AI-powered assistant that answers questions, provides educational content, and assists in developing curriculum plans. The assistant supports both text and real-time voice conversations via your device's microphone using WebRTC technology.
  • AI Image Generation: The ability to generate educational images and visual aids through the Homeschool Assistant and lesson page interfaces, powered by OpenAI's image generation models.
  • Curriculum Builder: AI-powered tools to create, organize, and share curriculum. Includes unit and lesson generation, stock photo integration for unit covers, educational video discovery, and a community library where users may optionally share curricula publicly.
  • 3D Interactive Experiences: Self-contained Three.js learning modules that can be created by administrators using an AI Studio (powered by Anthropic Claude) and accessed by users in a full-screen viewer.
  • Educator Dashboard: A dashboard for parents and educators to manage child profiles, track progress, plan schedules, maintain notes, manage shopping lists, and access all platform features.
  • Graduation Event Features: Tools for managing homeschool graduation ceremonies, including public registration forms, family and graduate management, ceremony ordering, announcer scripts, and parent-submitted audio name pronunciation recordings.
  • iOS Mobile Application: A native iOS app that provides access to your dashboard, child profiles, schedules, and AI chat features, communicating directly with our database and select API endpoints.

Our Services are primarily intended for use by parents, legal guardians, or educators to support student learning at home. The Site is not intended for direct use by students or children without adult supervision. Features and content may evolve or change as we improve our offerings.

By using the Services, you acknowledge that AI-generated responses (whether text, voice, or images) are produced by machine learning models. Content provided by AI is for educational assistance and should not be your sole source for critical decisions. Always use discretion and verify important information independently.

3. Account Registration and Eligibility

Account Creation: To access most features of our platform, you must create an account. When registering, you agree to provide true, accurate, and complete information (such as your name and a valid email address) and to keep this information updated. You must verify your email address before accessing authenticated areas of the platform. Each user must have their own account; you should not share account credentials with others.

Age and Parental Responsibility: By creating an account, you affirm that you are at least 18 years old (or the age of majority in your jurisdiction) and legally capable of entering into this agreement. The Services are intended for adults (parents, guardians, or educators) and not for direct use by minors. If you are creating an account to use the Services for the benefit of a minor child, you take full responsibility for that child's interactions with the platform and ensure compliance with these Terms.

Account Security: You are responsible for maintaining the confidentiality of your account login credentials. You must notify us immediately at support@enatehomeschool.com if you suspect any unauthorized use of your account. Enate Homeschool will not be liable for any loss arising from your failure to safeguard your account information.

4. Paid Services and Subscription

4.1 Free Tier and Usage Limits

Enate Homeschool offers a free tier with limited access to platform features. Free accounts are subject to usage caps — for example, a limit on the number of AI assistant messages per day. These limits are displayed within the app and may change over time with advance notice.

4.2 Subscription Features

Premium features are available through a paid subscription (“Plus”). Plus may include increased AI usage limits, enhanced curriculum generation, additional tools, and other exclusive features. Details of current Plus features and pricing are provided on the Site. Enate reserves the right to add, modify, or remove features of the subscription at any time with notice to subscribers.

4.3 Fees, Payment, and Billing

When you subscribe to Plus, you agree to pay the indicated fees in U.S. dollars. You authorize Enate or its payment processor (Stripe) to charge your payment method on the applicable billing cycle. Subscriptions renew automatically at the end of each billing period unless cancelled beforehand. If your payment method fails, we may suspend access to paid features until payment is received.

4.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings or by contacting customer support. Cancellation takes effect at the end of the current paid billing period; you retain Plus access until then. Unless required by law, we do not provide pro-rated refunds for unused portions of a subscription period.

4.5 Changes to Fees

We may change subscription fees with advance notice (via email or in-app notice). Fee changes apply at the start of the next billing cycle. If you do not agree to updated fees, you must cancel before the change takes effect. Continued use after a price change constitutes acceptance of the new fees.

4.6 Free Trials and Promotions

Enate may offer free trial periods for Plus. If you do not cancel before the trial ends, you will be charged at the standard rate. We will notify you of this at sign-up. We reserve the right to modify or terminate any trial or promotional offer at any time.

5. User Conduct and Acceptable Use

By using our Services, you agree to the following rules of conduct:

  • Lawful Purposes: You will use the Site and Services only for lawful purposes and will not violate any local, state, national, or international law or regulation.
  • Respectful Interaction: You will not post or transmit any content that is harmful, threatening, defamatory, obscene, harassing, or otherwise objectionable. Hate speech, bullying, or discrimination is strictly prohibited.
  • Responsible AI Use: You agree not to use the AI assistant, image generation tools, or 3D experience tools in ways that could cause harm. This includes not attempting to generate inappropriate, violent, or sexually explicit content, and not using these features to facilitate illegal activities. You agree not to attempt to manipulate AI systems into bypassing their design constraints.
  • Voice and Audio Use: When using voice conversation features, you must only record your own voice or that of individuals who have given their informed consent to be recorded. You must not use voice features to record others covertly. Graduation pronunciation recording links are personal and intended only for the family to whom they were issued — you must not share, transfer, or misuse these links.
  • Community Content Responsibility: If you choose to make your curriculum public in the community library, you are responsible for ensuring that the content complies with these Terms, does not infringe any third-party rights, and is appropriate for a homeschool educational context. You can make your curriculum private again at any time.
  • Intellectual Property Respect: Do not submit or share content you do not have the right to use. You will not upload or transmit material that infringes the copyright, trademark, or other intellectual property rights of any party.
  • No Spam or Malicious Activity: You will not use the Service to distribute unsolicited content or engage in activities that could harm the Site, such as introducing malware or attempting to probe or breach our security systems.
  • Account Integrity: You will not impersonate any person or entity, or misrepresent your affiliation with a person or entity. You will not access accounts that are not yours.
  • No Unauthorized Automated Access: Using automated means (bots, scrapers, or scripts) to access or extract data from our Services is not permitted except as expressly authorized by Enate in writing.

You are solely responsible for any content or data you input into the Site. If you misuse the Services or violate these rules, we may suspend or terminate your access. Unlawful conduct may be reported to the appropriate authorities.

6. User Content and Data Usage

6.1 What Is User Content

“User Content” means any information or material you provide to the Site or Services, including: messages and queries to the AI assistant, voice transcripts from voice conversations, audio pronunciation recordings, profile information, curriculum and lesson content, notes, shopping list items, schedule events, images generated through our tools, and graduation registration information and photos. You retain ownership of your User Content. Enate does not claim ownership over the content you provide.

6.2 License Grant to Enate

By submitting User Content, you grant Enate Homeschool a worldwide, royalty-free license to use, reproduce, and process your User Content for the limited purposes of:

  • Providing and operating the Services (e.g., processing your messages through AI models and returning responses)
  • Maintaining platform security and monitoring for misuse
  • Aggregated, anonymized usage analytics to improve platform performance
  • Promotional purposes using anonymized or de-identified success stories or feedback, only with your consent

We do not use your personal User Content — including chat history, voice transcripts, children's data, or curriculum content — to train AI models without your explicit opt-in consent.

6.3 Community-Shared Curriculum

If you choose to make a curriculum public in the community library, you grant other Enate users a non-exclusive license to view and use that curriculum for their own educational purposes. You can revoke this by making the curriculum private again at any time; however, use that has already occurred by other users cannot be undone.

6.4 Data Retention

Content you provide may be retained by Enate Homeschool for the duration of your account and for a reasonable period thereafter consistent with our data retention practices described in our Privacy Policy. Deleted curricula are soft-deleted and retained for 30 days before permanent removal. Raw voice audio from real-time conversations is not stored on our servers; only the resulting text transcript is saved.

6.5 Personal Information and Privacy

If you provide personal information, we will handle it in accordance with our Privacy Policy. By using the Site, you consent to the collection and use of information as outlined in these Terms and our Privacy Policy.

6.6 Third-Party Service Providers

To deliver our Services, we utilize the following third-party services. By using features powered by these providers, you acknowledge that your data may be processed by them subject to their own privacy policies:

  • OpenAI — AI assistant (text and voice), image generation, and curriculum content generation. Your messages, voice transcripts, and generation prompts are sent to OpenAI.
  • Anthropic — AI-powered 3D interactive experience generation (admin feature). Experience descriptions and iteration instructions are sent to Anthropic.
  • Supabase — Database, authentication, and file storage. All platform data including profiles, content, and uploaded files is stored with Supabase.
  • Stripe — Payment processing and subscription management. Payment data is handled directly by Stripe and not stored on our servers.
  • Unsplash — Stock photography for curriculum unit covers. Search queries (subject and topic keywords) are sent to Unsplash; no personal data is shared.
  • YouTube (Google) — Educational video search and embedding for lesson resources. Search queries are sent to the YouTube API.

7. Third-Party Links and Resources

The Site and Services may include links to third-party websites, YouTube videos, or other external resources for educational purposes. These third-party resources are not under Enate Homeschool's control, and their inclusion does not imply endorsement or association with us. We are not responsible for the content, privacy practices, or availability of third-party sites. Your use of any third-party resource is at your own risk and subject to that resource's own terms and policies.

8. Intellectual Property Rights

All content on the Site that is not User Content — including the platform's design, code, branding, logos, text, graphics, and AI-generated content produced by our system prompts — is owned by or licensed to Enate Homeschool and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services or platform content without our prior written consent.

AI-generated content (curriculum, lesson plans, images, 3D experiences) produced through your use of the platform is provided for your personal educational use. You may use and adapt it for your own homeschool activities. You may not resell AI-generated content produced by our platform as a standalone product.

Stock photos displayed in curriculum content are sourced from Unsplash and are subject to the Unsplash License. Attribution is displayed where required by API terms.

9. Disclaimer of Warranties

Enate Homeschool provides the Site and Services “AS IS” and “AS AVAILABLE,” and your use of them is at your own risk. To the maximum extent permitted by law, Enate disclaims all warranties and conditions, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. AI-generated content is provided for educational assistance only and may be inaccurate; we make no warranty as to the accuracy, completeness, or educational suitability of any AI-generated output.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Enate Homeschool and its owners, directors, officers, employees, affiliates, agents, and partners shall not be liable to you for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the Services — including but not limited to loss of data, loss of profits, or damages resulting from reliance on AI-generated content, voice transcription errors, or the acts of third-party service providers. Our total liability to you for any claims arising from these Terms or the Services shall not exceed the greater of (a) the amount you paid to Enate in the 12 months preceding the claim, or (b) $100 USD.

11. Indemnification

You agree to indemnify, defend, and hold harmless Enate Homeschool, its affiliates, and each of their respective officers, directors, agents, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; (d) your violation of any rights of a third party; or (e) any content you share publicly through the community library.

12. Termination and Suspension

Enate Homeschool reserves the right to suspend or terminate your account or access to the Services immediately, without prior notice or liability, if we determine that you have violated these Terms or any applicable law. You may also delete your account at any time through your account settings. Upon termination, your right to use the Services ceases immediately, and we may delete your data in accordance with our Privacy Policy and data retention practices. Paid subscription fees are not refunded upon termination for cause.

13. Changes to These Terms

Enate Homeschool may revise or update these Terms from time to time to reflect changes in our practices, features, technology, or legal requirements. When we make material changes, we will notify you by updating the “Last updated” date at the top of this page and, where appropriate, by email or in-app notice. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms of Use and any dispute arising out of or related to the Services or these Terms will be governed by and interpreted in accordance with the laws of the State of Texas, USA, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Texas, and you hereby consent to personal jurisdiction and venue in such courts.

15. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Enate Homeschool regarding your use of the Services and supersede all prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
